Rules

General Rules & Policies

Kipling Online Auction is a membership-based online auto auction marketplace that provides you with access to the largest auto auction inventory in the Jamaica.

We do not own the vehicles listed for sale. We simply provide an online platform that allows you to purchase vehicles that are originally sold by independent third-party sellers.

Our Rules & Policies are intended to provide you with information and resources about our Services, and to promote a fair bidding environment for our members. In addition to our Membership Terms and Conditions, the following Rules & Policies govern your use of our Services and your relationship with Kipling auction. Therefore, you must review all of our Rules & Policies before you bid to make sure you understand the auction process and the “as is” nature of the vehicles available for purchase through our Services.

Although these Rules & Policies are presented in an informal question-and-answer format, we want to make sure you understand that they are part of the binding, legal agreement that you enter into with us when you review and accept our Member Terms and Conditions. Thus, it is very important that you carefully review all of our Rules & Policies before placing any bids.

Remember, we are merely a marketplace that does not provide any representations, warranties, or guarantees regarding the quality or condition of vehicles listed on our website. We strongly encourage and advise you to inspect any vehicle prior to placing any bid or making any purchase. For more information, please review our Member Terms and Conditions and visit our Help Center.

We want to maintain a fair and enjoyable marketplace for our members, and we want you to be able to bid with confidence. Please review our General Rules & Policies before you bid on any item.

You must register and create an account.

You cannot bid on or purchase any vehicle without first registering and creating your Member Account. As part of the registration process, you must agree to our (Member Terms and Conditions).

Contact information.

We sometimes need to contact you regarding your account and your bidding or purchasing activity, so it is important that you keep your account information accurate and updated. You can update your contact information via your (My Account page).

Educate yourself on the auction process and our Services.

Before you place a bid or buy a vehicle, we strongly advise you to educate yourself on the auction process and our Services.

Primarily, we want to make sure you understand the nature of your transaction with us. Although you ultimately purchase the vehicle from us at the time of your bid the vehicles listed on our website are offered for sale by independent third-party sellers. In other words, the vehicles listed on our website are not owned by us nor in our inventory. Instead, the vehicles listed on our website are available for us to buy for the sole purpose of resale to you. The way this works is that when you place a bid on any vehicle using our Services, If your bid is the winning bid, you are obligated to purchase the vehicle from Kipling Auction for the amount of your bid (plus applicable fees).

 Do your own research.

Kipling Auction offer you the opportunity to get some great deals on some great vehicles. But, as you may know, purchasing a vehicle through an online marketplace presents a number of risks. Accordingly, you must do your own research to make sure you get the right vehicle for you.

Although each auction listing includes certain Vehicle Information, this Vehicle Information is provided by the auction seller and is for convenience only – meaning Kipling Auction do not independently review or verify any of the information provided, and we provide no representations, warranties, or guarantees regarding the accuracy or completeness of any Vehicle Information.

You have a right to inspect the vehicle, hire a competent motor vehicle valuator or do your own research into the condition of the vehicle, the cost of any repairs that may be necessary is your sole responsibility.

Agreement with service providers.

Although we may recommend or refer you certain third-party service providers for such things as vehicle inspection services and transportation services, any such service provider is an independent third-party that is not owned or operated by Kipling Auction. You understand and agree that if you decide to use any third-party service providers, your relationship with that service provider is governed by your contract or agreement (if any) with that service provider.

You cannot retract, delete, or cancel your bid for any reason.

Once you submit a bid, this cannot be undone. So you should carefully review the amount of your bid before submission.

You must pay for any vehicle you commit to buying.

If you submit a bid in an auction, you are making an irrevocable offer to enter into a binding contract to buy that vehicle from us if your bid is accepted. The same is true if you choose to “Buy it Now”.

If you fail to complete your purchase for any reason, we may cancel your transaction and you may be subject to additional fees and charges. In other words, if you do not intend to purchase the vehicle, do not place a bid.

You must be realistic with your expectations.

Many of the vehicles offered for purchase through Kipling Auction website are salvage or otherwise damaged vehicles. These vehicles may have additional or different damage than what is stated on the auction listing and may require substantial repairs at your expense. This is why we strongly recommend that you do your own investigation and research before placing any bid.

We make no representations, warranties, or guarantees regarding the condition or quality of the vehicles. All vehicles are sold “as is” and “where is” and “with all faults” and without any warranty of any kind, including any implied warranty of merchantability or fitness for a particular purpose.

You must notify us of any problems before the vehicle leaves the facility.

If you (or your agent or representative) identify any issue or problem with your vehicle or if the vehicle does not match the auction listing, you must notify us before the vehicle leaves the location where your vehicle is awaiting pickup. Once your vehicle leaves the location where your vehicle is awaiting pickup, you accept your vehicle “AS IS” and “WHERE IS” and “WITH ALL FAULTS”.

Increasing your deposit

If you wish to place a bid in an amount higher than $500,000 JMD, you must increase  your Security Deposit via your (My Account page). But keep in mind that you may not be able to increase your Security Deposit during an auction if the bids exceed your limit, so remember to add a high enough Security Deposit before the auction begins.

If you select the Buy It Now option, you are obligated to purchase the vehicle for the stated price (plus applicable fees). You cannot retract, delete, or cancel a Buy It Now bid for any reason.

Once your vehicle is removed (whether it is removed by you or by anyone acting on your behalf) from it’s location, you accept the vehicle “AS IS” and “WHERE IS” and “WITH ALL FAULTS”. If you have any questions, please contact our buyer services team at support@kiplingautoservices.com or 1 876-669-1280 before you bid.

Remember, we are merely a marketplace that does not provide any representations, warranties, or guarantees regarding the quality or condition of vehicles listed on our website. We strongly encourage and advise you to inspect any vehicle prior to placing any bid or agreeing to purchase any vehicle.

Retract a Bid.

You agree that you are obligated to pay the amount of any bid (plus all applicable fees) that you submit or authorize (or is otherwise submitted or authorized through or under your Member Account) if your bid is accepted. This includes all bids placed during the Preliminary Bidding Period and the live Virtual Auction and applies regardless of how or where your bid is placed.

 Bid rejection.

Kipling Auction (as operator of the auction) may in its sole discretion reject or cancel any bid at any time and for any reason without prior notice to you. Should a dispute arise regarding a bid, Kipling Auto Services (as the operator of Kipling auction) is the exclusive deciding authority with sole discretion in resolving disputes. You acknowledge and agree that any such rejection or cancellation is not within our control or discretion, and hereby release us from any related liability, damages, and losses. Please review our general release in our (Member Terms and Conditions for more information).

 Proxy Bidding.

Proxy bidding refers basically to automatic type of bidding. In an auction, when you place a bid and another user outbids you, you need to again come back and bid higher in order to remain the highest bidder. To avoid coming back, you can use automatic bidding which bids on behalf of you when someone outbids you. You can initially enter maximum amount with which you are comfortable with then our plugin will bid on behalf of you till that maximum amount is reached.

 live auction Vs pre-auction

Bids made during the live Virtual Auction will prevail over any bids made during the Preliminary Bidding Period of the same amount. For example, if you submit a maximum bid of $100,000 during the Preliminary Bidding Period and someone places a bid of $100,000 during the live Virtual Auction, you will lose unless you increase your bid amount during the live Virtual Auction.

Please review our How it Works tutorial for more information.

On Minimum Bid / Reserve price.

A vehicle sold “On Minimum Bid” means that the seller established a minimum bid or reserve price before the auction. If you are the high bidder and your high bid meets or exceeds the minimum bid, you will be obligated to purchase the vehicle at the end of the auction. However, if you are the high bidder but your bid does not meet or exceed the minimum bid, you will not be awarded the vehicle at the end of the auction. Instead, once the auction ends, you have the option to: (a) maintain your high bid or (b) increase your high bid. Additionally, the seller has the option to: (a) accept your high bid, (b) reject your high bid, or (c) make a counter offer.

Your high bid is binding even if the seller submits a counter offer.

You acknowledge and agree that even if the seller makes one or more counter offers, your high bid on any vehicle is an offer that cannot be revoked or cancelled and shall remain open to acceptance by the seller until 5:00 pm (Pacific) on the next business day after the auction date.

For example, you bid $500,000 on Vehicle A and your bid is the highest bid at the end of the auction. After the auction ends, the seller makes a counter offer of $600,000. Even if you do not accept the seller’s counter offer of $600,000, the seller may still accept your high bid of $500,000 before 5:00 pm on the next business day. You may not revoke or cancel your bid, even if the seller makes one or more counter offer.

You agree that your high bid is not accepted or rejected unless or until you receive notification from us of the same. You agree that the acceptance or rejection of your bid for an “On Minimum Bid” vehicle is not within our control or discretion and hereby release us from any related liability, damages, and losses. Please review our general release in our (Member Terms and Conditions) for more information.

You cannot bid on your own vehicle.

We may offer consignment sales for certain vehicles. If you consign a vehicle for sale, you may not bid on this item. We call this “shill bidding” and it is a violation our policies.

Similarly, if you know the seller of the vehicle, you cannot bid on the vehicle for the purpose of driving up the selling price. This rule applies to family, friends, partners, roommates, coworkers, employees, and others.
